Anyone who submits content for a GSCA Film Expo, Filmmaker Symposium, Conference, or other GSCA event must agree to the following terms. By submitting a form electronically, all parties agree to abide by the Content Submission Agreement outlined here as required to present the Film.
Agreement
The undersigned (“I,” “me,” “my,” or “myself”) is submitting to Giant Screen Cinema Association (GSCA) (“Organizer” or “GSCA”) a project (the “Film”) for consideration for the upcoming GSCA Event (the “Event”). By submitting the Film, I hereby acknowledge and agree to the following terms and conditions set forth in this Agreement (“Agreement”):
- I represent and warrant to Organizer that I am at least eighteen (18) years of age and that I am duly authorized, on behalf of myself and all other persons or entities who have ownership rights, licenses, or interests in or relating to the Film (collectively, the “Film Owners”), to enter into, and to grant the rights and make the representations, warranties, and other obligations under, this Agreement.
- I further represent and warrant, on behalf of myself and the Film Owners, that:
- the exhibition of the Film at the Event, by all technologies and means of delivery whether now or hereafter known or devised, will not violate any law or regulation, or infringe or otherwise violate any right of any third party, including, but not limited to, any copyright, trademark, or other intellectual property right, any right against defamation, or any right of publicity or privacy.
- the Film is free and clear of any pending or threatened litigation, arbitration, or other adversarial claim or proceeding.
- in connection with Organizer’s exercise of any rights granted to Organizer herein, all necessary licenses and consents have been and will be obtained, all license fees, clearance fees, and other obligations of any kind have been and will be timely paid in full, and the Event-Related Parties (defined below) will incur no obligations to make any payment to any third party; and
- there is no and will not be any license, lien, security interest, or other encumbrance in or to the Film, and there is no and will not be any license or contractual or other obligation, that could conflict or interfere with any of the rights or licenses granted to Organizer hereunder.
- I, on behalf of myself, the Film Owners, and all other Film-related parties, hereby jointly and severally irrevocably waive all legal and equitable rights relating to all liabilities, claims, demands, actions, suits, damages, and expenses, including but not limited to claims for copyright or trademark infringement, infringement of moral rights, libel, defamation, invasion of any rights of privacy (including intrusion, false light, public disclosure of private facts, and misappropriation of name or likeness), violation of rights of publicity, physical or emotional injury or distress, or any similar claim or cause of action in tort, contract, or any other legal theory, now or hereafter known in any jurisdiction throughout the world (collectively, “Claims”) arising directly or indirectly from Organizer’s exercise of the rights granted under this Agreement, including without limitation the submission, review, exhibition, advertising, and promotion of the Film, and any failure to exhibit the Film, and covenant not to make or bring any such Claims against Organizer or the Event, together with each of their parents, subsidiaries, affiliates, successors, officers, directors, employees, attorneys, agents, and representatives (collectively, “Event-Related Parties”), and forever release and discharge Event-Related Parties from liability under such Claims.
- I agree, on behalf of myself and the Film Owners, to indemnify and hold harmless Event-Related Parties, from and against any and all Claims arising from or relating to the Film or Organizer’s exercise of the rights granted under this Agreement, or arising from or relating to any breach or alleged breach of any representations, warranties, covenants, or obligations made by me or the Film Owners to Organizer, the Event, or any Event-Related Parties, including without limitation any express or implied representations, warranties, covenants, or obligations in this Agreement.
- The Event is open to submissions from anywhere in the world.
- The Event is conducted in English; however, submissions in other languages are welcome.
- I am a GSCA member, which I understand is a requirement to submit and present material for presentation. GSCA requires that both distributors and producers are members of the association to present a project. At the time the form is submitted, there must be no delinquent accounts with the GSCA or any predecessor organization.
- Projects must be submitted online, and each title should be submitted separately. All information must be completed. Incomplete forms will not be accepted. There must be a project name submitted with the submission form. A notation of “TBD” will not be accepted as a title.
- The schedule for the Event will be determined by the GSCA Film Priority Policy
- The exhibition format will be subject to venue availability.
- All presenters and attendees for the screenings must be registered for the Event. Registration is not included in the film submission fee and must be submitted separately.
- I grant consent for the Film to be available for viewing by all delegates and to be featured in both pre-marketing materials and in the Event program. If you would like to opt-out of inclusion in pre-marketing materials, please contact Tammy Barrett at tammy@giantscreencinema.com.
- I must provide a synopsis (up to 150 words) of the Film, which I understand will be used on the GSCA website and in marketing materials. GSCA reserves the right to edit the synopsis if the text is more than 150 words. Synopsis must be received no later than the deadline date published and e-mailed to tammy@giantscreencinema.com. GSCA cannot guarantee that information provided past the deadline will be included in materials printed for the Event.
- I grant consent for the submitted material to participate in any delegate evaluation process that may be included in the GSCA Event and understand that any information collected will be made available to the person who submitted the project.
- GSCA reserves the right to reject any submission or disqualify any submission believed to be in breach of any of this Agreement.
- GSCA reserves the right to reject any submission delivered past the delivery deadline or arriving in a condition that is not ready for assembly into the combined presentation.
- I am fully responsible for the safe transportation and insurance my submission and understand that shipping details will be provided separately.
- GSCA will take every reasonable precaution in handling submissions but is no way responsible for non-receipt, damage, or loss of any submissions.
- Submissions will be returned as soon as possible, but not earlier than two weeks after the completion of the Event.
- I agree to abide by the Policy and Procedures outlined on the GSCA website as required to present the Film.
- I understand that if the Film is not available for presentation at the Event, 50 percent (50%) of the original screening fee will be refunded to the submitting party.
- I understand that if the project is moved from one category to another (i.e. New Film to Film in Production), GSCA cannot guarantee that accommodation will be available.
- The GSCA staff will not have the authority to waive fees or accept projects after the final deadline. Only the GSCA Executive Committee may waive fees.
- The official method of submission is to electronically submit the online form. By submitting the form electronically, all parties agree to abide by the Content Submission Agreement outlined above as required to present the Film.
